Members of Congress *are* servants of the president. All US citizens are.
Check international law then trace back the money they are paid.
One advantage of not being an American is that I do not need to yes sir statements about US law. The US Constitution is basically a bluff, it has worked so far but it is still a bluff. Within a few years of the whites leaving a lot of Britain's other ex-colonies had suspended their constitutions. The USA is the exception.

Providing the US President is the only person in charge of both the FBI and the NSA there is sufficient separation. A close eye needs to be kept on orders from the President and the interface between the two organisations. Fortunately Congressmen and Senators can read documents such as Presidential orders.
