If it is retail Windows XP, Microsoft is not concerned about PC
ownership.
PC ownership is not relevant.
If Brian has the actual Windows XP license he ahs Windows XP.
He could also contact Microsoft:

Possibly get a replacement key and then Microsoft could mark that key
as stolen.
