If you didn't get the installation media for the operating system either
as a retail version or a restore CD then you did not get a legal copy of
the operating system. I had an aunt that purchased a used PC from her
company that promised to include Windows but no installation media was
provided (and none could be generated by a utility on the drive) so she
never really got the OS. The company had simply left the software of
the drive but kept it all and so the sale was fraudulent. Once I
pointed it out to them, they immediately accepted a return of the
system.
