The icon is probably setting itself up during the
full boot of your system. You may find that you cannot
delete the file no way, no how, as the file always
sets itself to be "used" by Windows as you do a full
boot, but there may be another solution. Try booting up
in "safe Mode". This way Windows only loads the absolute
minimum and necessary software to run the system.
To do this, reboot and press F8 during boot up. You
should get a screen which gives you the option of booting
in "safe mode" choose this option. Once the system has
booted up, I suspect you will be albe to delete the file.
clean your recycle bin and re-boot in normal mode. If
the icon keeps appearing later... You may have spyware.
Beware of the so called "anti-spyware" programs. I
often wonder if they are installing their own little brand
of spyware, themselves. Look occasionally in your "program
files" directory and determine if there are any directories
which are not associated with a program you have installed.
If so, you may have spyware installed and you may have
problems deleting these directories. If you do, make
absolutely certain the directories are not necessary and
use the above procedure to delete them.
Hope this helps
