Access debied on file

Hey,
I'm having a problem. Someone copied soms files to our
fileserver. Now I (as an administrator) can NOT change the
permission or take ownership of this folder. Even When I
ask the properties The security tab is not available. When
I try to take owership of the folder above, he still gives
me an access denied on that folder. I tried almost
everything to access that file. Any ideas?
