Ok. The national state of Robert Moir's house has outlawed spyware, with
strong finanial penalties for first time offences and captial punishment for
repeat offenders.

I trust most people would agree that takes care of the "strong" part of the
legislation.

Now comes the "effective" part. Ooops it appears that i have about as much
recognition as a legal authority outside of my house as most countries have
in most other countries. Legislation isn't effective because the way laws
work does not take into account the way things like the internet work. Even
for those areas where there is a clear violation of well known non computer
related law (e.g. child pornography) which is used to combat computer based
crime, we've already got no end of problems with enforcement across borders,
crimes being taken as seriously in one place as they are in another, etc.

I don't think legislation is the answer, at least not with the international
framework as it stands.
