You chose to buy OEM.
Microsoft and the seller have a contract.
You and the seller have a contract.
However there is nothing between you and Microsoft.
The day it is legislated Microsoft need to support OEM is the last day
OEM is sold, so you will pay the higher retail.
You need to think of OEM as if it is manufactured, sold and supported
by the seller and not Microsoft.

What did the seller have to say when you contacted them?

If Panda was damaging Windows how is that Microsoft's fault?

Did you try System Restore?
Start/All Programs/Accessories/System Tools/System Restore.
