Yup. That's one reason I lean towards a non-technical solution for
that particular aspect of security. Basically, if your system is
cracked and used as a base for attacking others, _you_ are on the
hot-seat. If you can't show that you took proper steps to secure your
system, you get charged as an accomplice. Proper steps, at a minimum,
includes keeping up-to-date on security patches, running a properly-
configured firewall and not activating services that aren't needed or
are known to be vulnerable (and if the system won't work without the
vulnerable services, that's not an excuse).
When someone goes out in a vehicle they can't handle, loses control and
plows into a crowd of people, we don't accept "I didn't know how to drive
that." as an excuse. Why should computers be any different?
