I manage a large Eastern division of a company. In addition to being a
manager I have 20+ years in the IT business. On my networks everyone
signs a document stating that all communications via company resources
are property of the company and will/are monitored at any time without
notice/permission. In my years I've found what seemed to be good
employees spending an increasing amount of time doing "Personal" things
with the computer, and with the internet being common now, they spend
even more time on the net doing personal things.
Your company is responsible for anything that leaves their network, and
is also responsible for anything ON their network. If they let one lamer
abuse the system then try and enforce a "Rule" on another lamer the
second can claim that the company is harassing them since they were
aware of the first lamer and did noting - you must be consistent and
fair in all cases or you can't have rules.
As for your personal email - you can bet they know when you try to send
mail, and you can bet the log it. I check my logs using scripts every
day - and send notices with the fragment of the log that relates to them
and ask them to stop. If the offender doesn't stop it's a warning, time
off, then firing.
When I first got this position there was no one monitoring the traffic -
in less than a month I actually found an employee working in our office
that was working for the competition under several managers noses. I
quietly collected the evidence, and then presented it to our HR & Legal
departments and then fired the chap. I also sent notice to the company
that should I see them bidding on anything we had that I would take them
to court - never saw them at any meeting after that.
Personal email is just that - personal - get/send it from HOME not WORK.
