Dial-up Security: Is this a known problem?

My concern is that once I try to get on the net with a brand new installation
(fdisk, format, re-instal), the problem is still there. I'm wondering if my
actual telephone call has been hijacked! Does anyone have anything to say on
that? I looked at dialerspy.com, but couldn't figure out how to configure it!
I'm not even sure it's what I need.
Each and every time I connect (AOL!), it shows a speed of 32000 bps.
Occasionally, the person amuses himself by making it read 0 bps. What can I do
about this? If my telephone call is actually being re-directed, isn't that a
felony which should interest the law enforcement community?!
Also: does anyone know the exact link to the pest patrol site which provides
the small download and online scan, instead of the complete download and
offline scan?
