Actually no. The ITAR as it was then was not under DoD.

]paper book to invoke AM1 and thus be able to let the world know about a safe

Again, your knowledge of history is miniscule. Zimmermann's code for PGP
1.0 was released onto the net by person or person's unknown, and was
thus exported. When 2.3 came out Zimmermann had come to an agreement
with MIT who released it, together with source code only to US or Cdn
citizens in the USA or Canada.
When ViaCrypt and later PGP inc went into production, they printed the
source code in book form.

Z did NOT print it in book form. That was later.
In the case of Schneier, the source code was always in the book, but the
accompanying floppy disk was not given an export license.

In neither case did anything ever come to court, never mind the Supreme
Court.

Maybe, or maybe not. If you have insider information, let us know,
otherwise your speculations are worth nothing.

That the USA is heading down a very frightening path I do not dispute,
but what is needed are facts not arrant speculation.
