No, not at all.

No. It seems like it wouldn't hold up anyways since the disclaimer is not
agreed to before the message is accepted.

It's a legal method to protect a company from liability when a
representative screws up while doing something such are responding to an
email list such as this one, or while responding to an email inquiry for
information. It also protects them against problems when you download
generic drivers from a company such as Lucent, maker of a chipset used by
many different manufacturers, instead of the actual vendor. Please note:
This only applies to the United States and if you require a definative
answer, consult a Legal Expert in your country for the proper wording to
use. If it is a critical issue, then the small cost of proper Legal Advice
is well worth the reduction in liability exposure.
